Arizonans Support Medical Marijuana

65% of Arizona voters support removing criminal penalties for the medical use of marijuana, according to a February 2009 poll. And voters have already passed medical marijuana initiatives twice in the state, in 1996 and 1998. Unfortunately, due to a technical error in the wording of these laws, they have failed to effectively protect medical marijuana patients from arrest. The initiative that will go before voters in 2010 will close this loophole and give patients the protection and peace of mind that Arizonans agree they deserve.

The Arizona Medical Marijuana Policy Project (AMMPP) is a grassroots organization devoted to passing a medical marijuana initiative in Arizona in November 2010. Currently, seriously ill people who use marijuana on the advice of their doctor to treat illnesses such as cancer, AIDS, and multiple sclerosis are subject to arrest and imprisonment, simply for trying to stimulate their appetite or alleviate their pain. We can change this. On November 2, 2010, Arizona voters could have a chance to vote to protect Arizona’s medical marijuana patients from arrest and jail. But voters will not have that chance unless we collect more than 150,000 valid signatures to get the initiative on the ballot. Our signature drive is now underway! ACTION; There are a number of medical cannabis (marijuana) bills in play in states across the US. Here we network on Ways anyone can help with the effort to make each a medical marijuana state. We need to get the word out and people contacting reps and officials and get this legislation into law. Also, lets not forget efforts at the Federal level.

Also phone call and read off and/or visit and hand deliver the info. OFF-LINE, You can take literature with you and approach businesses, organizations and even people on the street while you're out and about. Wear your pot-leaf shirt and register voters, as feasible. Gather signatures for any related petitions that are happening at the time as well.

SUMMARY: Ballot Proposition 200 -- Approved by 65% of voters on Nov. 5, 1996 Effective: Dec. 6, 1996 [Not Active] Measure changed sentencing for drug offenders, requiring those who commit violent crimes to serve full sentences without parole, and diverting non-violent drug offenders into treatment. Prop 200 also permitted doctors to prescribe schedule I controlled substances, including marijuana, to treat a disease or to relieve pain and suffering in seriously ill and terminally ill patients. Under federal law, however, marijuana is considered an illegal drug and physicians are prohibited from writing prescriptions for illegal drugs. The use of the word "prescribe" instead of "recommend" is the reason that Prop 200 is not considered to make medical marijuana legal in Arizona.

Amendments: Not Amended: House Bill 2518, which was signed by the governor on Apr. 21, 1997, sought to repeal Proposition 200’s medical marijuana provision by requiring the Food and Drug Administration (FDA) to first approve marijuana before allowing state physicians to prescribe it. The bill was placed on the Nov. 3, 1998 ballot as a referendum, where voters rejected it by a vote of 57% to 43%.

SUMMARY: Sixty-five percent of voters approved Proposition 200 on November 5, 1996, which included several provisions regarding prison reform and one specific to the use of medical marijuana.   The law took effect on December 6, 1996. It mandates alternative sentencing for non-violent drug offenders, and seeks to establish legal protections for seriously ill patients by allowing doctors to "prescribe" schedule I controlled substances such as marijuana. However, because federal law ultimately forbids physicians from prescribing such drugs, this statute does not adequately protect patients from state-level criminal penalties, as do similar state laws that only require patients to possess a physician’s "recommendation" that medical marijuana therapy may be beneficial. So, while a majority of Arizona voters have passed ballot measures enacting legislation to allow the use of medica marijuana, the laws do not adequately protect patients nor Doctors who would prescribe it.  The legislation as it is currently enacted requires Doctors to write a prescription for medical marijuana to their patients. Since marijuana is still classified as a Schedule 1 drug, the FDA effectively forbids Doctors from doing so. Subsequent ballot initiatives to correct the legislation have thus far failed. Legal and medical status of cannabis - Wikipedia, the free encyclopedia | Cannabis is in Schedule IV of the Single Convention on Narcotic Drugs, making it subject to special restrictions. Article 2 provides for the following, in reference to Schedule IV drugs:

A Party shall, if in its opinion the prevailing conditions in its country render it the most appropriate means of protecting the public health and welfare, prohibit the production, manufacture, export and import of, trade in, possession or use of any such drug except for amounts which may be necessary for medical and scientific research only, including clinical trials therewith to be conducted under or subject to the direct supervision and control of the Party.

This provision, while apparently providing for the limitation of cannabis to research purposes only, also seems to allow some latitude for nations to make their own judgments. Help put medical marijuana on the 2010 ballot! - Last update: July 10, 2009 | Imagine if you were seriously ill and the medications your doctor prescribed did not help ease your pain and suffering. But your doctor said there was a medicine that could help you; however, it's illegal to use. This is the sad reality for many sick and dying Arizona residents, and you can help change it.

The Arizona Medical Marijuana Policy Project has begun a signature drive to get an effective medical marijuana law on the ballot for 2010. However, we cannot do it without your help. In order to get on the ballot, the AMMPP must collect 153,365 valid signatures before July 2010. AMMPP is paying $1 for every valid signature turned in. Don't miss this opportunity to set your own hours and get paid $9 to $15 an hour by working as an independent contractor, all while helping to protect the sick and dying! In order to be able to help out, you must be an Arizona resident and be able to pass a criminal background check to circulate petitions, and bring a government-issued ID as well as a utility bill or vehicle registration showing your Arizona address. And, of course, collecting this many signatures is not going to be cheap. Would you please consider donating at least $10 right now, so AMMPP can afford to place this compassionate act on the ballot?

This won't be the first time a medical marijuana initiative has been on the ballot. In 1996, 65% of Arizona voters supported a medical marijuana initiative. Unfortunately, the initiative was flawed in that it allowed patients to use medical marijuana only with their doctors' "prescriptions." It is against federal law for a doctor to "prescribe" marijuana. A doctor can, however, "recommend" marijuana. An effective medical marijuana law, therefore, must provide for physician recommendations rather than prescriptions. AMMPP's initiative is careful crafted to provide true protection to the seriously ill. 1. Since 1996, twelve states have legalized medical marijuana use: AK, CA, CO, HI, ME, MT, NV, NM, OR, RI, VT, and WA. Eight of the twelve did so through the initiative process. Hawaii's law was enacted by the legislature and signed by the governor in 2000, Vermont's was enacted by the legislature and passed into law without the governor's signature in May 2004, Rhode Island's was passed into law over the governor's veto in January 2006, and New Mexico's legislation was signed into law by Governor Bill Richardson on April 2, 2007.
